Welcome to Trademark Name Checker (the "Service"), a free tool operated by Weijie Zhang ("we," "us," or "our") at trademarknamechecker.com. By accessing or using the Service, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
1. What the Service is
The Service is an automated, informational tool that compares a name you enter against public records from the U.S. Patent and Trademark Office (USPTO) and shows similarity signals — by sound, spelling, and goods/services class — together with the underlying public marks. It is a preliminary screening aid for your own research.
2. Not legal advice; no attorney-client relationship
The Service does not provide legal advice. It is software that presents public data and computed similarity signals. Nothing the Service outputs is a legal opinion, a determination of registrability, availability, or infringement, or a recommendation about whether to adopt, file, or use any name.
Using the Service does not create an attorney-client relationship between you and Weijie Zhang. We are not your lawyers. For advice about your specific situation, consult a licensed trademark attorney.
3. No warranty ("as-is")
The Service and all results are provided "as-is," without warranties of any kind, express or implied. The underlying data may be incomplete, out of date, or inaccurate, and the Service does not cover common-law/unregistered marks, state registrations, foreign marks, or many other factors relevant to a trademark analysis. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. You use the Service and rely on its results at your own risk.
4. Limitation of liability
To the fullest extent permitted by law, Weijie Zhang and anyone associated with the Service will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of (or inability to use) the Service — even if advised of the possibility of such damages.
Our total aggregate liability for any and all claims relating to the Service will not exceed the greater of (a) the total amount you paid us to use the Service in the twelve months before the claim (which, for a free service, is US $0) or (b) US $0. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
5. Acceptable use
When using the Service, you agree not to:
- scrape, crawl, or bulk-query the Service, or otherwise place an automated or excessive load on its endpoints;
- present or resell the Service's output as a certified, official, or complete trademark clearance;
- imply the Service is affiliated with, endorsed by, or acting on behalf of the USPTO or any government body;
- reverse engineer, disrupt, or attempt to gain unauthorized access to the Service; or
- use the Service for any unlawful purpose or in violation of these Terms.
We may rate-limit, suspend, or block use that we reasonably believe violates this section.
6. Data source and attribution
Data is derived from public records published by the U.S. Patent and Trademark Office (USPTO). The USPTO does not endorse, sponsor, or verify the Service, and the Service is not affiliated with the USPTO or any government agency. USPTO data is subject to the USPTO's own terms of use.
7. Intellectual property
The Service's software, design, scoring logic, and original text are owned by Weijie Zhang. The underlying USPTO records are U.S. government public records. These Terms grant you a limited, personal, revocable license to use the Service for your own research; they grant no other rights.
8. Changes and termination
The Service is a personal project and may change, be interrupted, or be discontinued at any time, in whole or in part, without notice or liability. We may modify these Terms at any time; material changes will be reflected by updating the "Last updated" date above, and continued use after a change means you accept the revised Terms.
9. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Los Angeles County, California will be the exclusive venue for any dispute arising out of or relating to the Service or these Terms, and you consent to their jurisdiction.
10. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the Service.
